2. Definitions

Company, we, us, or our means QA Building Supplies Pty Ltd. 

Customer, you, or your means any individual, company, contractor, business, or entity purchasing goods from us. 

Goods means all products, materials, equipment, accessories, and supplies sold by us. 

Website means the QA Building Supplies online store and associated digital platforms. 

 

3. Orders

3.1 All orders are subject to acceptance by QA Building Supplies. 

3.2 We reserve the right to refuse, cancel, or limit any order at our sole discretion. 

3.3 An order confirmation does not constitute acceptance of the order. Acceptance occurs when goods are dispatched or collected. 

3.4 Orders cannot be cancelled once goods have been dispatched without our written approval. 

 

4. Pricing

4.1 All prices displayed are in Australian Dollars (AUD). 

4.2 Prices are inclusive of GST unless otherwise stated. 

4.3 We reserve the right to change prices at any time without notice. 

4.4 If a pricing error occurs, we may cancel the order and provide a full refund. 

4.5 Freight, delivery charges, pallet fees, fuel levies and special handling charges are additional unless expressly stated. 

 

5. Payment

5.1 Payment must be made in full before dispatch unless a credit account has been approved. 

5.2 We accept payment methods displayed on our website. 

5.3 Ownership of goods remains with QA Building Supplies until payment has been received in full. 

5.4 We reserve the right to suspend deliveries or future orders where payment remains outstanding. 

 

6. Product Information

6.1 Product images are provided for illustration purposes only. 

6.2 Actual products may vary in colour, appearance, dimensions, packaging, or specifications. 

6.3 Product specifications may change without notice by manufacturers. 

6.4 Customers are responsible for confirming product suitability before purchase. 

 

7. Delivery

7.1 Delivery times are estimates only and are not guaranteed. 

7.2 QA Building Supplies is not liable for delays caused by: 

• Weather events 

• Traffic conditions 

• Supplier shortages 

• Industrial action 

• Transport provider delays 

• Events beyond our reasonable control 

7.3 Risk in the goods passes to the customer upon delivery or collection. 

7.4 The customer must inspect goods immediately upon receipt. 

7.5 Any shortages, damage, or delivery discrepancies must be reported within 24 hours of delivery. 

7.6 Deliveries are made to ground level access unless otherwise agreed. 

7.7 Failed delivery attempts will incur additional delivery charges. 

 

8. Click & Collect

8.1 Collection notifications will be provided once orders are ready. 

8.2 Customers must provide proof of purchase and identification when collecting goods. 

8.3 Risk transfers to the customer upon collection. 

8.4 Uncollected orders may be cancelled after 30 days. 

 

9. Returns and Refunds

9.1 Returns are accepted only with prior approval. 

9.2 Goods must be: 

• Unused 

• In original packaging 

• In resaleable condition 

• Returned with proof of purchase 

9.3 Approved returns may incur a restocking fee of up to 20%. 

9.4 Custom-made, special-order, clearance, cut-to-size, tinted, mixed, or non-stock items cannot be returned unless required by Australian Consumer Law. 

9.5 Freight charges are non-refundable unless required by law. 

9.6 Refunds will be processed using the original payment method. 

 

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Competition and Consumer Act 2010 (Cth) including the Australian Consumer Law. 

Where goods are supplied to consumers, they come with guarantees that cannot be excluded under Australian law. 

Customers are entitled to: 

• A replacement or refund for major failures 

• Compensation for reasonably foreseeable loss or damage 

• Repair or replacement where goods fail to meet acceptable quality standards 

 

11. Warranties

11.1 Manufacturer warranties apply where offered by the manufacturer. 

11.2 QA Building Supplies does not provide additional warranties beyond those required by law unless expressly stated in writing. 

11.3 Warranty claims may require inspection and assessment before approval. 

 

12. Limitation of Liability

To the maximum extent permitted by law: 

1. a) Our liability is limited to:

• Replacing the goods; 

• Repairing the goods; 

• Supplying equivalent goods; or 

• Refunding the purchase price. 

1. b) We are not liable for:

• Consequential loss 

• Loss of profit 

• Loss of business opportunity 

• Project delays 

• Labour costs 

• Third-party claims 

arising from the supply, delivery, installation, or use of goods. 

 

13. Retention of Title

13.1 Ownership of goods remains with QA Building Supplies until all amounts owing have been paid in full. 

13.2 Until ownership passes: 

• The customer holds goods as bailee for QA Building Supplies. 

• We may recover goods where payment remains overdue. 

• The customer grants us access to premises for recovery of goods if necessary. 

 

14. Credit Account Customers

Where a trade or credit account has been approved: 

14.1 Payment terms are strictly 30 days from end of month unless otherwise agreed. 

14.2 Overdue accounts may incur interest at 2% per month calculated daily. 

14.3 Customers are responsible for all reasonable debt recovery costs, collection agency fees, legal costs, and enforcement expenses. 

14.4 We may suspend or terminate credit facilities at any time. 

 

15. Intellectual Property

15.1 All website content remains the property of QA Building Supplies. 

15.2 Customers must not copy, reproduce, distribute, modify, or commercially exploit website content without written consent. 

15.3 Trademarks, logos, product descriptions, graphics, and images remain protected intellectual property. 

 

16. Website Use

Users must not: 

• Use the website unlawfully 

• Upload malicious software 

• Interfere with website functionality 

• Attempt unauthorised access to systems 

• Misrepresent their identity 

• Engage in fraudulent transactions 

We reserve the right to restrict access to any user who breaches these conditions.

19. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. 

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales. 

 

20. Amendments

QA Building Supplies reserves the right to amend these Terms and Conditions at any time. 

Updated versions will be published on our website and become effective immediately upon publication.
